Manuscript Types

Jurnal Hukum Islam (JHI) publishes original scholarly manuscripts that contribute to the advancement of Islamic legal studies through theoretical, doctrinal, empirical, comparative, and interdisciplinary approaches. Manuscripts must demonstrate originality, academic rigor, a clear contribution to existing scholarship, and relevance to the journal's aims and scope.

The journal considers the following types of manuscripts:

1. Original Research Articles

Original Research Articles present the findings of original research that makes a significant contribution to Islamic legal studies. Research may employ qualitative, quantitative, mixed-methods, doctrinal legal research, socio-legal inquiry, comparative law, or other appropriate methodological approaches.

Articles should clearly articulate the research problem, theoretical or conceptual framework, methodology, findings or legal analysis, and contribution to existing scholarship. Empirical studies should explain their data sources and analytical procedures, while doctrinal studies should demonstrate systematic and critical analysis of relevant legal materials.

2. Review Articles

Review Articles provide a critical and comprehensive synthesis of existing scholarship on a specific topic within Islamic law and related disciplines. They should identify major debates, theoretical developments, methodological trends, research gaps, and promising directions for future research.

Review articles must go beyond descriptive summaries and demonstrate a clear analytical contribution. Systematic reviews and other transparent evidence-synthesis approaches are welcome where appropriate to the research question.

3. Comparative Legal Studies

Comparative Legal Studies examine similarities, differences, and interactions between legal systems, institutions, doctrines, or practices. Manuscripts may compare Islamic law with national legal systems, compare legal developments across jurisdictions, or analyze the relationship between Islamic legal principles and international legal frameworks.

Submissions must establish a clear comparative framework, explain the selection of jurisdictions or cases, and provide critical analysis that advances understanding beyond a simple description of legal differences.

4. Socio-Legal and Empirical Studies

Socio-Legal and Empirical Studies investigate the relationship between law and society, including the implementation, interpretation, negotiation, and social consequences of Islamic legal norms and institutions.

Relevant topics may include legal pluralism, access to justice, family law practices, religious authority, dispute resolution, Islamic financial institutions, legal reform, and the interaction between state law and religious norms. Manuscripts must demonstrate methodological transparency, appropriate empirical evidence, and ethical research practices.

5. Theoretical and Conceptual Articles

Theoretical and Conceptual Articles develop, critically examine, or refine concepts, theories, and analytical frameworks relevant to Islamic law and contemporary legal scholarship.

Such manuscripts should offer a clearly defined intellectual contribution, engage critically with relevant literature, and explain the implications of the proposed argument or framework for legal theory, legal institutions, or future research.
