Implementasi Hukum Ekonomi Syariah dalam Startup Fintech Berbasis Artificial Intelligence di Indonesia

The development of financial technology (fintech) based on Artificial Intelligence (AI) has significantly transformed the Islamic finance sector in Indonesia. As the country with the largest Muslim population globally, Indonesia holds a strategic position in developing an innovative and inclusive Islamic fintech ecosystem. This study aims to analyze the implementation of Islamic economic law in AI-based fintech startups in Indonesia, focusing on regulatory frameworks, compliance challenges, and industry development opportunities. The research employs a normative juridical approach with descriptive-qualitative analysis through literature review of regulations, fatwas, industry reports, and relevant academic studies. Findings indicate that despite the existing regulatory foundation through the Islamic Banking Law, OJK regulations, and DSN-MUI fatwas, regulatory fragmentation and institutional disharmony impede legal certainty. Key challenges include delayed fatwas for technological innovations, dual supervision by OJK-BI, unclear blockchain and smart contract regulations, and vulnerability to Sharia-based fraud. AI integration provides opportunities for operational efficiency, Sharia-compliant credit scoring, real-time fraud detection, and financial inclusion. Recommendations include regulatory harmonization, establishment of a dedicated Islamic fintech Task Force, development of Sharia-compliant AI standards, and enhancement of Sharia-based digital financial literacy to create a sustainable and globally competitive Islamic fintech ecosystem.
