Abstract

This study aims to analyze the legal politics underlying the regulation of the number of ministries as stipulated in Article 15 of Law Number 61 of 2024, as well as to examine the ideal concept for determining the number of ministries in accordance with the needs of an effective and efficient government administration within Indonesia’s presidential system. The study is motivated by the amendment to the regulation concerning the number of ministries, which no longer provides a clear limitation, thereby creating the potential for multiple interpretations and legal uncertainty, while also affecting the effectiveness and efficiency of governance. On the other hand, the President’s authority to establish ministries as part of presidential prerogative rights must remain subject to the principle of checks and balances. This research employs a normative legal research method using statutory, conceptual, and comparative approaches. The study utilizes secondary legal materials analyzed through a descriptive qualitative method, involving stages of data collection, processing, and deductive interpretation to obtain a comprehensive understanding. The findings indicate that the regulation contained in Article 15 of Law Number 61 of 2024 has a ratio legis intended to provide flexibility for the President in adjusting governmental institutional needs. However, the provision does not establish clear criteria regarding the formation of ministries, thereby potentially creating legal uncertainty. Therefore, an ideal concept regarding the number of ministries is required, based on the principles of effectiveness, efficiency, actual governmental needs, and the strengthening of the presidential system, so that ministries do not merely serve as instruments of political compromise, but are instead oriented toward public service and effective governance.
