Kewajiban Negara terhadap Pengungsi Pasca Banjir Aceh Perspektif Siyasah Syariyah

Recurring floods in Aceh displace thousands of residents and reveal problems that extend beyond aid distribution alone. In practice, displaced persons still lack a firm legal status, policy discretion is difficult to audit, and post-emergency rights recovery remains fragmented. This article aims to formulate the state's obligation towards post-flood displaced persons in Aceh through a siyāsah framework: public protection as the policy objective, priority for vulnerable victims, proportionality of action, and administrative accountability. The study uses qualitative normative legal research and applies siyāsah as an analytical tool to examine Law No. 24 of 2007, Aceh regulations, and displacement policy documents. Legal and policy materials are analyzed through qualitative content analysis and normative interpretation, strengthened by source triangulation. The findings show that although disaster-management mandates are tiered, protection for displaced persons remains weak when public-purpose legitimacy, vulnerability-based priority, limits on emergency coercion, and accountability are not institutionalized through clear displaced status, cross-agency coordination, reliable registration, and sustained recovery. Closing that implementation gap is essential so state obligations remain measurable on syarī grounds after floodwaters recede.
