Abstract

Ihdād is a period of mourning that must be observed by a wife whose husband has passed away. During this period, a wife is prohibited from wearing adornments and from doing things that may attract the attention of the opposite sex. However, in Botekan Village, Ulujami District, Pemalang Regency, many women have not carried out ihdād in accordance with the provisions of Islamic law and Indonesian positive law, even though these rules are clearly regulated. This study is a field research with a descriptive-analytical approach. It examines legal provisions related to ihdād and analyzes their implementation in society. The research uses an empirical juridical or legal sociology approach by observing legal realities that occur in the community. The results of this study show that the awareness of career women regarding the obligation of ihdād in Botekan Village is still low. Many career women do not fully implement the provisions of ihdād after the death of their husbands. Several factors influence this condition, including economic needs, lack of legal knowledge, and occupational demands, especially for women who work as Civil Servants (PNS). As a result, public perceptions of the implementation of ihdād law vary widely. Situational and personal circumstances often play a significant role in shaping individual behavior toward religious and legal obligations.
