Abstract

Agreements made between workers or laborers and employers or employers that contain terms, rights and obligations of the parties are known as employment agreements. However, the implementation of work agreements is often carried out not in accordance with the legal terms of the agreement, both according to the regulations of the Positive Law Act and in Islamic Law. There are two formulations of the problem in this study, namely how is the practice of abusing circumstances in the distribution of labor in the Doro District? and what are the legal consequences that occur towards the practice of abusing the situation regarding the distribution of labor in Doro District? The purpose of this research is to find out the practice of abusing the situation in the distribution of labor and the legal consequences that occur from the practice of abusing the condition of the distribution of labor in Doro District. This type of research is empirical juridical by using legal, conceptual and case analysis approaches. The results of this study concluded that in the District of Doro there are three places for the distribution of labor as housemaids. The agreement from one of the distribution locations is not in accordance with the agreement in general, namely by not fulfilling one of the legal terms of the agreement. In addition, the practice of distributing labor in Doro District, Pekalongan Regency, has not complied with the legal regulations that apply to a place of distribution of labor, that the three distribution places have not been registered as an official agency for distributing labor and from this it can have several consequences. law, including agreements made that can be canceled, not getting a way of settlement if a problem occurs through legal channels, and so on.
