Defensive Jihad as an Instrument for Restoring Religious Freedom and Civil Rights: An Analysis of QS. Al-Hajj [22]:39–41: Al-Nasafi and Yusuf al-Qardhawi’s Perspectivestives of Al-Nasafi and Yusuf al-Qaradawi

This study would find out how the classical doctrine of jihad in QS. Al-Hajj [22]:39–41, according to al-Nasafi’s perspective, can be methodologically integrated by reinterpreting maqāṣid al-syarīʿah by referring to the thought of Yusuf al-Qardhawi (1926–2022 A.D./1444 H), thus resulting in a juridical-theological framework positioning defensive jihad as an instrument for restoring religious freedom and civil rights. This study answered this through comparative interpretation (muqaran), by tracing the relationship between the two textual reasons for the ability (ibāhah) of qitāl in al-Nasafi (461–537 H) in al-Taysir fi al-Tafsir, the restoration of Muhajirin civil rights and protection from military aggression as a form of protection of religious freedom with the operationalization of both into one coherent category through the framework of maqāṣidī al-Qardhawi in Fiqh al-Jihad (2009). This study contributed by offering a comparative interpretive model bridging classical normative affirmations (taʿrif al-minnah) with contemporary operational frameworks-maqāṣidī, as well as being a theoretical foothold for human rights discourse in the study of the interpretation of qitāl verses.
